In conducting our search we utilised search queries as described. Accordingly, potentially relevant records may not have been encompassed by our search in the search queries utilised. For example, it is a common practice of many organisations to hold patents in a company that is separate from the primary trading company. Please advise if you would like us to extend our search by reviewing our search queries. 6. In some cases, we may only review the titles and abstracts of records to determine their relevance. This strategy is adopted in order to contain the costs of the search. However, the title and abstracts of all patent applications are not always a good indication of the subject matter described in the patent specification. Consequently if the patent or application did not appear to be relevant on the basis of the title or the abstract, a relevant record may not have been identified by our search. Please advise if you would like us to extend our search by obtaining and reviewing a copy of the complete patent specification for each of the records. 7. Our search of patent records through the AusPat database can be limited to cases which were in force as of the date of the search. T here are provisions in the Australian patents act pursuant to which lapsed patents or patent applications may be restored in certain circumstances. Consequently a relevant patent or patent application which had lapsed at the search date but has since been restored, or might in the future be restored would not be identified by our search. 8. IP Australia has advised that a significant number of Australian patent records are not properly indexed to an International Patent Classification (IPC) mark. These records primarily derive from International PCT applications which included incomplete or absent IPC details. Due to this error, and as our searches typically utilise the International Patent Classification system, there is the possibility that a patent covering the subject material belongs to this group of unclassified patents and would not have been revealed in our search.
